Children should remain silent, and they are ‘good’ when they’re quiet, but ‘bad’ when they are not, because they are disturbing the adults and causing trouble. This attitude runs through the way people interact with children on every level, and yet, they seem surprised when it turns out that children have been struggling with serious medical problems, or they’ve been assaulted or abused.

The most common response is ‘well why didn’t the child say something?’ or ‘why didn’t the child talk to an adult?’ Adults constantly assure themselves that children know to go to a grownup when they are in trouble, and they even repeat that sentiment to children; you can always come to us, adults tell children, when you need help. Find a trusted adult, a teacher or a doctor or a police officer or a firefighter, and tell that adult what’s going on, and you’ll be helped, and everything will be all right.

The thing is that children do that, and the adults don’t listen. Every time a child tells an adult about something and nothing happens, that child learns that adults are liars, and that they don’t provide the promised help. Children hold up their end of the deal by reporting, sometimes at great personal risk, and they get no concrete action in return. Sometimes, the very adult people tell a child to ‘trust’ is the least reliable person; the teacher is friends with the priest who is molesting a student, the firefighter plays pool with the father who is beating a child, they don’t want to cause a scene.

Or children are accused of lying for attention because they accused the wrong person. They’re told they must be mistaken about what happened, unclear on the specifics, because there’s no way what they’re saying could be true, so and so isn’t that kind of person. A mother would never do that. He’s a respected member of the community! In their haste to close their ears to the child’s voice, adults make sure the child’s experience is utterly denied and debunked. Couldn’t be, can’t be, won’t be. The child knows not to say such things in the future, because no one is listening, because people will actively tell the child to be quiet.

Children are also told that they aren’t experiencing what they’re actually experiencing, or they’re being fussy about nothing. A child reports a pain in her leg after gym class, and she’s told to quit whining. Four months later, everyone is shocked when her metastatic bone cancer becomes unavoidably apparent. Had someone listened to her in the first place when she reported the original bone pain and said it felt different that usual, she would have been evaluated sooner. A child tells a teacher he has trouble seeing the blackboard, and the teacher dismisses it, so the child is never referred for glasses; the child struggles with math until high school, when someone finally acknowledges there’s a problem.

This attitude, that children shouldn’t be believed, puts the burden of proof on children, rather than assuming that there might be something to their statements. Some people seem to think that actually listening to children would result in a generation of hopelessly spoiled brats who know they can say anything for attention, but would that actually be the case? That assumption is rooted in the idea that children are not trustworthy, and cannot be respected. I’m having trouble understanding why adults should be viewed as inherently trustworthy and respectable, especially in light of the way we treat children.

This hits really close to home for me, too- every time I told my mother I felt ill, or I couldn’t feel anything, or that there was anything wrong, it was brushed off. Every time I ‘complained’ about a legitimate problem- and there were a lot of them- she blew it off, and the more I complained, the more I was considered to be whining and making things up, to the point where I didn’t tell her when I was sexually abused, because I didn’t think she’d believe me- after all, she never did before? By the time I was twelve I stopped telling my mother about any of my legitimate problems, because she wasn’t really to be trusted.

A nation continues to wait for final word on the Supreme Court’s Big Four cases, but the justices’ closest call arrived first on Monday, in a ruling that just made your right to remain silent a lot more complicated — just ask Dzhokhar Tsarnaev.

A nation continues to wait for final word on the Supreme Court’s Big Four cases this term — voting rights, affirmative action, DOMA, and Proposition 8 — but the justices’ closest decision arrived first on Monday, in a 5-4 ruling on Salinas v. Texas in which the conservative members of the Court and Anthony Kennedy determined that if you remain silent before police read your Miranda rights, that silence can and will be held against you. Here’s what that means.

Basically, if you’re ever in any trouble with police (no, we don’t condone breaking laws) and want to keep your mouth shut, you will need to announce that you’re invoking your Fifth Amendment right instead of, you know, just keeping your mouth shut. “Petitioner’s Fifth Amendment claim fails because he did not expressly invoke the privilege against self-incrimination in response to the officer’s question,” reads the opinion from Justice Samuel Alito, which Justice Kennedy and Chief Justice John Roberts backed. Justices Thomas and Scalia had a concurring opinion while the remaining four Supremes dissented.

The Salinas case revolves around Genovevo Salinas, a man who was convicted of a 1992 murder of two brothers. Salinas was brought in for police questioning in January 1993. According to the dissenting opinion of Justice Breyer, he was called in to “to take photographs and to clear him as [a]suspect” and Salinas was questioned without being read his Miranda rights:

Because he was “free to leave at that time,” [App.14], they did not give him Miranda warnings. The police then asked Salinas questions. And Salinas answered until the police asked him whether the shotgun from his home “would match the shells recovered at the scene of the murder [Id., at 17.] At that point Salinas fell silent.

That silence was then used against Salinas in court, and he was eventually convicted. But the bigger question in revisiting this 20-year-old murder case was whether or not prosecutors were allowed to point to that silence, and win a case using Salinas’ own silence against him.

You know what’s a much more recent wrinkle to the potential precedent effect of today’s ruling? A case like that of the younger Boston Marathon suspect, Dzhokhar Tsarnaev, who reportedly sat through 16 hours of questioning before he was read his Miranda rights. Had Tsarnaev, who was recovering from serious injuries at the time, remained silent during questioning without explicitly invoking his Fifth Amendment, prosecutors could, under the Salinas ruling, now use that silence to their advantage.

It all seems ridiculously terrifying, this idea that in order to claim your Fifth Amendment, you now need to know how to call the on-the-fly legal equivalent of “safesies.” Your right to remain silent just got more complicated, and it will require potential criminals to be more informed about their protections and the linguistic details on how to invoke them. “But does it really mean that the suspect must use the exact words ‘Fifth Amendment’? How can an individual who is not a lawyer know that these particular words are legally magic?” Breyer wrote.

This doesn’t sit right with me at all. Our rights aren’t dependent on whether or not we state them out loud. That is, after all, why we write them down. Very likely, this ruling will be used disproportionately against US immigrants and less informed citizens. My faith in the Supreme Court is falling by the day.

Actually, this is REALLY important guys. The reason the Miranda rights began being said outloud in the first place is so those who weren’t aware of them could have the knowledge when they were arrested. By needing someone to declare them before they take effect, it does the opposite—those who aren’t aware of them are at a clear disadvantage. This could affect immigrants and people of lower education (or even those unfamiliar with the system) more powerfully, and it can obviously be abused.

Silence should not be misconstrued as evidence. This is an unfair system.

Furthermore, rights aren’t dependent on whether or not they’re said out loud. The whole point of a right is that it is inherent (or should be inherent) to the human condition (or the humane treatment of people). To have a right needed to be declared before it takes effect goes against the entire point of even having them.

This is something that should bother you.
